I deeply regret having Bill Montecucco represent me in a gross misdemeanor reckless driving charge. It was a “weak case” where the Clark county Prosecutor and Clark County Sheriff would wait until just a few days before expiration of statute of limitations. I found they have done this a number of times – I call it the “Diversion Pipeline”. In this situation, evidence disappears, memories fade. Bill initially thought we would have a very good chance of prevailing in court. I did not do what I was accused of. Bill charges a lot of money for every little thing. This case was complex and required much work to prepare. Bill changed, I would call him and tell him the Sheriff’s were lying, as was the person who filed the report against me – that I just did not do this. To this Bill became dismissive. It was very difficult to deal with him, and as such, I had little confidence in going to court – I suffered a lot of duress. Bill called me with an offer for diversion Things had been so bad, I had gone to another attorney who explained things better. I did stipulate that in no way would I admit guilt. Bill presented diversion as a better outcome than even a not guilty verdict. I accepted diversion on his advice. On the day of entering diversion, Bill was good enough, but upon leaving the courtroom, he told me he had a stroke during the month he was negotiating the diversion. He also told me he was something like a guest judge, or visiting judge , in the traffic court. Something like that. Upon hearing of his stroke, I thought “Great, what else can go wrong?” Later, I did a download of how the cases are tried like mine, waiting so long to charge. There were a number. I also found a video clip on local community television where Clark County Prosecutor, Tony Golik, describes in some time like May, 2012, that diversion is a program for first time offenders to admit their guilt and have their charges dismissed. Mind you, my not guilty plea never changed. My big problem with Bill is that he is wishy-washy on law enforcement corruption. He states he doesn’t care about law enforcement dishonesty. I found the deputy prosecutor in this case, Kai Nuce, to be something like a Gestapo punk. It all boils down that when I needed an attorney who believed in me that I was only telling the truth and needed that lawyerly defense against an overzealous and deceitful prosecutor, he did not stick up for me. Because Bill is a part time judge, does he play judge with his clients? And I sincerely question that Bill suffered cognitive impairment from his stroke, due to his erratic behavior. It is with heavy heart that I write this. Maybe your situation is different, where you know in your heart of hearts you are guilty, then Bill will smooze some sort of deal for you. This greatly cost me personally as well as the thousands Bill took in fees.
Man, where can I even start? I got a crazy ticket for speeding and I have a commercial driver license and I thought my license was in jeopardized and I was able to get in contact with Bill and Bill was able to take care of everything if you ever get a ticket in the state of Washington area hit up bill and he will take care of you once again thank you so much appreciate it.
