Still on cloud nine, still amazed I escape the broken justice system that turned its wrath on me for my political activism/demands for transparency, accountability, and justice. Keys to ‘victory’: never losing faith that a jury would see the truth, and having Kathy in my corner! Here’s my attempt to make a LONG story short: I was a victim of police misconduct in Benbrook, TX, and following the experience, I filed a formal complaint. They admitted wrong-doing on the minor allegations, but on the bigger issues, the Chief of Police and City Manager said the officers were not at fault. The whole investigation was a farce, and I called them out for being corrupt as can be. I filed open records requests and the officers’ reports showed they CLEARLY lied (the officers claimed they suspected me of stealing from a construction site… and there was NO CONSTRUCTION SITE!) But every ‘leader’ in Benbrook turned a blind eye to the facts, and instead engaged in a smear campaign. So, from November 2020 onward, I became a dedicated activist in Benbrook – I even ran for Benbrook City Council. I admit to being a thorn in their side, but I was always careful to stay within the law as far as my protests went. But in Summer 2024, the BPD arrested me for ‘Interference with Public Duties’ because, they alleged, I was too close to officers in public – only a Class B Misdemeanor, but they threw the book at me. I was assaulted by police, held for 48 hours in jail, given highest bond/harshest bond conditions, had my phone seized and ALL of its contents downloaded, and more. With the entire cabal of corrupt ‘leaders’ in Benbrook colluding with their cronies in Tarrant County Criminal DA’s office, I was facing an uphill challenge. My first lawyer dropped me after I refused to accept plea deals. A true ‘David v. Goliath’ struggle, and who was going to believe one guy against the police and elected officials lined up against me? Kathy even provided me with over six pages of testimony these ‘leaders’ were prepared to use against me if I were found guilty. Almost all of the testimony was – like the original BS about a construction site – totally fabricated, absolutely false. The risk of going to trial and the pressure to take a plea deal, however, was very real. And waiting months for my day in court was VERY tough – not to mention all the harm from being arrested, placed on bond, subject to at least five ‘pre-trials’, having to get a second lawyer, etc. I think it’s fair to say my case was tough on everyone – including Kathy. Reading some of the reviews about Kathy’s raising her voice, or being ‘rough on the edges’, stubborn, too pessimistic in saying ‘You’re going to lose’, yeah… I get that. She can be difficult at times, it’s true. And it’s probably true also that Kathy and I are too much alike in many ways to really have gotten along ‘swimmingly’ at all times! So, as the trial approached, I was worried that a pessimistic outlook might undermine my defense. OMG was I ever wrong!!! Kathy kicked their arses in court! She was 1000 times tougher on the lying police officers than she was on me in her office. She was prepared, focused, and her delivery was incomparably better than the prosecutor’s. I can’t say it enough: if you believe in your case, and you want the hardest-hitting defender you can find to fight for you in court, go with Kathy. And I can’t stress enough how glad I am I followed her advice about not testifying – even though, of course, I wanted to tell the jury THE TRUTH. But after nearly two days of trial, it took the jury less than thirty minutes to find me ‘NOT GUILTY’. And several members of the jury stuck around to tell Kathy how well she did, how well she exposed the corrupt case against me, and – no kidding – several of the jury members asked her for her card in case they needed a defender in the future. So that’s my story. I never lost faith in going to trial, and I thank God that I had Kathy in my corner. Good luck to you in your case – the criminal justice system needs a ton of reform. In the meantime though, GO WITH KATHY!
