I used Eric Funderburk when I had an accident with my 2014 Explorer. I knew to the core something went wrong. After 3 years of destroying my mental capacity. I swore innocence. He never looked at the accident site until 3 years later. We sat for trial as scary as it was he kept telling me to take a plea and if I took it I could go home to Memphis with my kids and never have to come back and if I didn’t , then it may get drawn out and the prosecuting attorney may go into labor soon and there was no telling how long it would go on. The judge asked if I felt pressured and I was fearful to speak up. So I paused and didn’t speak until he asked again and I started crying and told him no. My atty told me he would do an accident reconstruction which never happened; I asked him where the inspection of my car was. He stated he didn’t have one. The officer ( investigator) seemed shady and didn’t show up for court but once we walked to our car he called my husbands cellphone and asked how it went. I also found there was a court date the week before where I was accidentally sent a copy no one told me about and it was a motion for lemign ? I think but they wouldn’t tell me what it meant. We lost our son. I told him there were recalls coming out on my car bc I knew something was wrong. He never checked them. This was 2016. My trial was set for 2019 going to court every month for 3 years. I offered to pay for reconstruction . He never charged me but told me he was getting a company to do it and I could share costs with another man in the same situation? In the end he told me the officer stated that during the crash that I flew across the car and ended in passenger seat. I offered a witness that showed up immediately after and within the same lay 2 days before trial he said he didn’t need him. There is a recall for over 600,000 ford explorers that would explain this accident. The judge explained I could never go back and change my plea. They sold my car to coparts and I literally called the places that bought the parts to try to purchase what could have possibly saved me and I had no luck . I still get recalls this many years later. I cannot get a job due to the charges I have and besides our family being broken and the changes of not having our boy. I live with the plastering of the most terrible things all over the internet about me. I was a proud citizen before the accident and now I live in a shell and rather not exist. I felt from the beginning he had no experience in this situation . I initially hired his wife and went to my first appearance ever to write down and be questioned and she never showed up as my lawyer and it ruined any trust I could have there on. She says her husband could help me and that it was much more his area. I met his father as well and would have been happy to even have him represent me. I don’t speak negative on public record and it has taken me all these years to make this review. The worst part is knowing the officer wasn’t truthful as well and I don’t know how anyone could live with that. God will be the one to manage that situation. I have lived with this every single day and sheltered myself for the last several years- and trusted him. I refused to plea and we stood in the hallway as a jury was ready for what seemed a few hours and he would try to convince me to take a plea and I refused over and over until he finally said if I took it then I could go home to my kids and never come back. I get to Memphis and they stated I was the only person to ever be watched on probation from an accident . They only had murderers, sex crimes, and drug convicts. He told me my plea would be a misdemeanor but here in Tn it appears it’s not so I had to be watched by a probation officer . I only wanted someone to believe me and help me or refer me because they cared.
