Frequently Asked Questions

What is the difference between an O-1 and an EB-1 petition for immigration law New York clients?

The O-1 is a nonimmigrant visa for individuals with extraordinary ability in their field, providing temporary US work authorization. The EB-1 is an employment-based immigrant visa — a path to a green card — also requiring extraordinary ability but leading to permanent residency. Many New York professionals start with an O-1 and later transition to an EB-1 as they build their US track record, and immigration law New York attorneys like Marina Fooksman can plan the full trajectory strategically.

How long does a green card application take through USCIS’s Manhattan office?

Processing times vary by visa category and applicant country of birth. Employment-based adjustment of status through USCIS’s New York offices typically runs 12 to 18 months for most categories. Priority date backlogs affect applicants from India and China significantly. An immigration law New York attorney can monitor priority dates, file concurrently when eligible, and use premium processing where available to minimize delays.
