Frequently Asked Questions

How does immigration status affect divorce and child custody proceedings in Fort Myers?

Immigration status can intersect with Florida family law in important ways. Non-citizen parents have the same parental rights as citizens in Florida custody proceedings, but practical considerations — such as travel restrictions, pending visa applications, and potential removal proceedings — may affect custody arrangements. Courts consider the child’s best interests above all, but an attorney familiar with how these factors interact can better protect a non-citizen parent’s position in Lee County proceedings.

What is the process for modifying a child support order in Lee County?

Florida allows modification of child support when there has been a substantial, material, and unanticipated change in circumstances — such as a significant income change for either parent or changed custody arrangements. A petition for modification is filed with the Lee County circuit court. The requesting party must demonstrate that the change justifies recalculation under Florida’s income shares model. Having legal representation at a modification hearing significantly improves the likelihood of a favorable adjustment.

Cannot speak highly enough of Christina and how she handled my case! She is extremely knowledgeable of the law, very calm, astute, and efficient. I felt at ease with her throughout the process. She handled things in a timely manner and always knew the answer to my questions. She’s a math wiz, spreadsheet master, and can find math errors by opposing counsel with ease. Michelle, her legal assistant, is kind, professional, and organized as well. Wish there were 6 stars I could rate this law practice!

After a horrible experience with a different attorney in Fort Myers, FL, I was referred to to Ms. Holly’s office by another highly reputable family law attorney. I called her office and advised her of my very complicated case. She agreed to represent me; her fees are reasonable and her expertise fantastic. She is not deterred by shady tactics or threats from opposing counsel and she remained calm and professional throughout my case.

Excessive wait time

Christina Holly has represented me in a divorce proceeding involving a vindictive and litigious ex spouse making endless filings with no basis in fact or law. It is in this environment that Christina has successfully advocated for me from January 2018 through November 2024 with positive outcomes at every hearing and motion decision. Her professionalism, knowledge of the law, and the respect afforded her by the court for her thoroughness and effective advocacy was impressive! I knew I was in the right hands. The choice I made back in 2018 to have her represent me was significant and impactful! I could not have chosen a better counselor. She was Heaven sent Forever grateful to her

Christina does an AMAZING job with the way she does things. She is very professional, has a lot of compassion, and gives her all for you. I have a 15 year old daughter with a father who barely gives her the time of day and has been trying to argue with me on her child support. Christina helped me push my point through and through and I couldn’t have asked for a better lawyer. Best lawyer I could have ever chosen. Thank you Christina.

She’s been awesome throughout my whole case!

Christina Holly is extremely thorough. I knew having her on my side, I would be in the best of hands. I appreciated her guidance and care during a very stressful time. I would recommend her to anyone needing assistance during a divorce or child custody case. Her paralegal, Kristin, is wonderful and responsive. I greatly appreciate them both.

Following devastating experiences with other attorneys, I finally found someone who made me feel at ease and protected in family court. Christina treated me with respect and was always a step ahead in regards to anything that needed to be done. If you’ve hired Christina then consider yourself safe. I’m forever thankful for the way she took on my case and provided me with the best outcome possible.

My Personal experience is a positive one

Christina and her team are a pleasure to deal with. I had a divorce case that was a total disaster from the previous attorneys. I hired Christiana, that is when I realized how bad the other attorneys were. She always responds, kept me updated and got the job done. Her fees are very reasonable. If you want to be guided through a terrible time in your life with facts hire Christina. If you want to be lied to and over billed hire whoever you are thinking. Its this simple HIRE CHRISTINA HOLLY.
