Frequently Asked Questions

How long do I have to file a personal injury claim in California?

California’s statute of limitations for most personal injury claims is two years from the date of the injury. If the injury was not immediately discovered, the clock may start from the date of discovery. Claims against a government entity have a shorter window — typically six months to file an administrative claim. Missing these deadlines generally bars you from recovering any compensation, so consulting an attorney promptly after an accident is critical.

What compensation can I recover in a California personal injury case?

California allows injured parties to seek economic damages (medical bills, lost wages, future care costs) and non-economic damages (pain and suffering, emotional distress, loss of enjoyment of life). In cases involving egregious conduct, punitive damages may also be available. California follows a pure comparative fault rule, meaning your recovery is reduced by your percentage of fault but not eliminated unless you are 100% responsible.
